Terms of Service

1. Acceptance of Terms

By accessing and using FileShot.io ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

FileShot.io is a temporary file-sharing platform built around privacy-first principles. Files you upload are stored privately, expire automatically, and—when you enable zero-knowledge mode—are encrypted in your browser before they ever touch our servers.

3. Zero-Knowledge Encryption Promise

When zero-knowledge encryption is enabled (free and paid tiers), your browser generates an encryption key, encrypts the file locally, and only then sends the ciphertext to us. We never receive your key, cannot decrypt the file contents, and cannot read embedded metadata. Pro and Creator users can also enable additional server-side protections such as branded links and password prompts, but the zero-knowledge flow always keeps the decryption key on your side.

Because of our zero-knowledge architecture, we can only provide the encrypted blob plus limited metadata (upload time, file size, expiration). Since we never have your encryption key, we cannot decrypt your files. Your data remains protected, and you remain in complete control of the passphrase.

User Responsibility: You are solely responsible for remembering and securely storing your encryption password. If you lose your password, we cannot recover your files—this is by design to ensure true zero-knowledge encryption. We recommend using a password manager to store your encryption passwords securely. Encryption happens entirely client-side in your browser before upload.

4. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not upload illegal, harmful, or malicious content
• Not attempt to breach security or access unauthorized areas
• Not use the Service to distribute malware, viruses, or spam
• Respect intellectual property rights of others

5. Prohibited Content

You may not upload files containing:

• Illegal content or content that violates laws
• Copyrighted material without authorization
• Malware, viruses, or harmful code
• Adult content, hate speech, or harassment
• Personal information of others without consent

6. File Storage and Deletion

Files uploaded to FileShot.io are stored temporarily and automatically deleted after their expiration period. Typical defaults are:

• Free tier: 30 minutes to 180 days (default 180 days)
• Pro tier: 1 hour to unlimited
• Creator tier: 1 hour to unlimited (no expiration required)

For zero-knowledge transfers, we store only the encrypted blob plus the metadata you see in "My Files." We reserve the right to delete files immediately if they violate these terms or breach our quotas.

Security Scanning & Abuse Prevention: To protect users and keep the Service reliable, we may apply automated security controls such as antivirus scanning, file-type validation, blocked/suspicious extension checks, rate limiting, and abuse detection. For standard (non-zero-knowledge) uploads, these checks may include scanning file contents for malware. For zero-knowledge uploads, we cannot access readable file contents (we only receive ciphertext), so enforcement may rely on metadata, file size, upload patterns, and filename/extension-based checks. We may quarantine, restrict access to, or delete files when we reasonably believe they pose a security risk, violate these Terms, or are required to be removed by law.

Server Management & Auto-Deletion: To ensure service availability for all users, FileShot.io automatically manages server storage. When server storage capacity is reached, files may be automatically deleted in the following priority order: (1) expired files (all tiers), (2) free tier files (oldest first), (3) paid tier files (only if expired). This automated cleanup ensures the service remains available and prevents storage-related outages. Users are responsible for backing up important files—FileShot.io is designed for temporary file sharing, not permanent storage.

7. Privacy and Data Safety

FileShot.io is built with your privacy and data safety as our top priority. We do not permanently store your files or personal information beyond the expiration period. Metadata retained is limited to what is required to operate the service (account email, expiration, download counts).

Your Data is Safe: With zero-knowledge encryption enabled, your files are encrypted in your browser before upload. We store only encrypted data that we cannot decrypt—the encryption key never leaves your device. This means your sensitive data is protected from unauthorized access and data breaches.

Pro and Creator plans offer generous storage and transfer allowances designed to meet the needs of most users. Creator tier includes unlimited storage, unlimited transfers, and unlimited expiration periods. To ensure fair usage and maintain service quality for all users, we reserve the right to implement reasonable usage limits or rate limiting if we detect patterns that may indicate abuse, automated bulk operations, or usage that could negatively impact service performance for other users. Such measures are implemented only when necessary to protect service integrity and are applied fairly and transparently. Normal usage patterns will not be affected.

8. Service Availability

FileShot.io is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• That files will be available for the full expiration period
• Recovery of deleted files

PDF Editor & Tools Disclaimer: FileShot.io's PDF Editor and other tools (compressor, converter, etc.) are provided free of charge with no watermarks, no signups required, and no usage limits. However, these tools are provided "as-is" without any guarantees. File processing happens server-side to perform operations (conversion, compression, editing), which means files must be readable by our servers during processing. Files are immediately deleted after processing completes. We are not responsible for any data loss, processing errors, or file corruption that may occur during tool usage. Users are responsible for backing up original files before using any FileShot.io tools.

9. Limitation of Liability

FileShot.io and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service, including but not limited to loss of data or files.

10. Subscription Terms & Storage Limits

Pro and Creator subscriptions are billed monthly and automatically renew unless cancelled. You may cancel your subscription at any time through your account dashboard. Refunds are provided at our discretion and are generally available for unused portions of the current billing period if cancellation occurs within 14 days of the initial subscription or renewal. No refunds are provided for partial months after the 14-day period. Chargebacks or payment disputes may result in immediate account suspension or termination.

Storage Limits: Each subscription tier has specific limits. Free tier: 50 GB total storage with 10 GB per-file limit, 90-day expiry. Lite tier ($2/mo): Unlimited storage, 50 GB per-file limit, 1-year expiry. Pro tier ($5/mo): Unlimited storage, 100 GB per-file limit, unlimited expiry. Creator tier ($12/mo): Unlimited storage, 300 GB per-file limit, unlimited expiry. These limits are designed to ensure fair usage and service availability for all users.

Creator tier includes unlimited storage, unlimited transfers, and unlimited expiration periods. Pro tier offers up to 100 GB per file and unlimited expiration. To ensure fair usage and maintain service quality for all users, we reserve the right to implement reasonable usage limits or rate limiting if we detect patterns that may indicate abuse, automated bulk operations, or usage that could negatively impact service performance for other users. Such measures are implemented only when necessary to protect service integrity and are applied fairly and transparently. Normal usage patterns will not be affected.

Service Modifications: FileShot.io reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, including but not limited to features, functionality, pricing, or availability. We will provide reasonable notice for material changes that affect paid subscriptions. We are not liable for any loss or damage resulting from such modifications, suspensions, or discontinuations.

10a. Paid Access & Selling Files

Pro and Creator tier users may enable paid access on their files, allowing them to sell files through FileShot.io's payment system. By enabling paid access, you agree to the following terms:

• Stripe Connect Required: You must connect a valid Stripe Connect account through the Affiliate Dashboard to enable paid access. FileShot.io uses Stripe to process payments securely.
• Minimum Price: Files must be priced at a minimum of $0.99 USD (or equivalent in supported currencies).
• Platform Fee: FileShot.io charges a 9% platform fee on all paid file transactions. This fee is deducted from the payment before funds are transferred to your Stripe Connect account.
• Payment Processing: All payments are processed through Stripe. FileShot.io is not responsible for payment processing delays, Stripe account issues, or payment disputes. You are responsible for managing your Stripe Connect account and resolving payment issues directly with Stripe.
• Refunds: FileShot.io does not handle refunds for paid files. Refund requests must be processed directly through your Stripe account. FileShot.io's 9% platform fee is non-refundable.
• Prohibited Content: You may not sell files containing illegal content, copyrighted material without authorization, or content that violates these Terms. Violations may result in immediate termination of paid access privileges and account suspension.
• Tax Obligations: You are solely responsible for reporting and paying any taxes, fees, or duties applicable to income earned through paid file sales. FileShot.io does not provide tax advice or withhold taxes.
• No Self-Purchases: You may not purchase your own files. Attempts to do so may result in account suspension.
• File Availability: Once a file is purchased, the buyer gains access to download the file. FileShot.io is not responsible if the file is deleted, expires, or becomes unavailable after purchase. We recommend setting appropriate expiration dates for paid files.

By enabling paid access, you represent and warrant that you have the right to sell the content and that the sale does not violate any laws or third-party rights.

10b. Affiliate Program

FileShot.io offers an affiliate program that allows users to earn commissions by referring new customers. Participation in the affiliate program is subject to the following terms:

• Eligibility: All registered users may participate in the affiliate program. You must have a valid Stripe Connect account to receive commission payments.
• Commission Structure: Affiliates earn between 30% and 50% commission on all subscription payments from referred users, depending on the affiliate's subscription tier (Free/Lite: 30%, Pro: 40%, Creator: 50%). Commission rates are subject to change with 30 days' notice.
• Referral Tracking: Referrals are tracked through unique affiliate links. You are responsible for ensuring your affiliate links are used correctly. FileShot.io is not responsible for lost commissions due to incorrect link usage or technical issues.
• Commission Payment: Commissions are calculated automatically but paid manually by FileShot.io through Stripe Connect. Payment timing and frequency are at FileShot.io's discretion. Commissions are only paid for successful, completed subscriptions.
• Fraud Prevention: FileShot.io reserves the right to withhold or cancel commissions if we detect fraudulent activity, including but not limited to self-referrals, fake accounts, or manipulation of the referral system. Violations may result in immediate termination from the affiliate program and account suspension.
• Tax Obligations: Affiliates are solely responsible for reporting and paying taxes on commission income. FileShot.io may issue tax forms as required by law.
• Program Changes: FileShot.io reserves the right to modify, suspend, or terminate the affiliate program at any time with or without notice. Changes to commission rates will be communicated with 30 days' notice.
• Prohibited Activities: You may not use spam, misleading claims, or deceptive practices to promote FileShot.io. Violations may result in immediate termination from the affiliate program.

10c. API Access & Webhooks (Creator Tier)

Creator tier users have access to FileShot.io's API and webhook functionality for programmatic file uploads and server notifications. API and webhook usage is subject to the following terms:

• API Keys: API keys are provided to Creator tier users and must be kept confidential. You are responsible for securing your API keys and for all activity performed using your keys. If your API key is compromised, you must immediately regenerate it through your account dashboard.
• Rate Limiting: API usage is subject to reasonable rate limits to ensure service stability. Excessive API usage that impacts service performance may result in temporary or permanent API access restrictions.
• Webhook Security: Webhooks are delivered to URLs you specify. You are responsible for securing your webhook endpoints and validating webhook signatures. FileShot.io is not responsible for webhook delivery failures or security breaches at your endpoints.
• Prohibited Use: You may not use the API to:
  • Upload illegal, harmful, or malicious content
  • Automate bulk operations that violate rate limits or service terms
  • Circumvent security measures or access unauthorized areas
  • Resell API access or create proxy services
• API Availability: FileShot.io does not guarantee uninterrupted API availability. We reserve the right to modify, suspend, or discontinue API functionality with reasonable notice to affected users.
• Support: API documentation is provided, but technical support for API integration is limited. FileShot.io is not responsible for integration issues or API-related development costs.

Violation of API terms may result in immediate revocation of API access and account suspension.

10d. Custom Branding & White-Label Features (Creator Tier)

Creator tier users may enable custom branding and white-label features for their file sharing pages. Custom branding is subject to the following terms:

• Branding Content: You may upload custom logos, colors, and branding elements to customize your file sharing pages. You represent and warrant that you have the right to use all branding content and that it does not violate any third-party rights.
• Prohibited Content: Custom branding may not include:
  • Misleading or deceptive content
  • Content that impersonates FileShot.io or other entities
  • Illegal, harmful, or offensive content
  • Content that violates intellectual property rights
• Service Attribution: FileShot.io reserves the right to display minimal service attribution (e.g., "Powered by FileShot.io") on white-label pages. This attribution may not be removed or obscured.
• Branding Removal: FileShot.io reserves the right to remove or disable custom branding that violates these terms or applicable laws. Violations may result in loss of custom branding privileges.
• No Endorsement: Custom branding does not constitute an endorsement or partnership between FileShot.io and your brand. You may not claim such an endorsement.

11. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Termination by You: You may terminate your account at any time through your account dashboard. Upon termination, your account and associated data will be deleted in accordance with our data retention policies. Active subscriptions will remain active until the end of the current billing period, after which they will not renew.

Termination by FileShot.io: We may terminate or suspend your account immediately if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, you will lose access to all files, data, and Service features. We are not obligated to provide refunds for terminated accounts.

Effect of Termination: Upon termination, all licenses granted to you under these Terms will immediately cease. Files and data associated with your account may be deleted immediately or after a reasonable grace period. You are responsible for backing up any important data before termination.

12. Intellectual Property and User Content

You retain all ownership rights to the content you upload to FileShot.io. By uploading content, you grant FileShot.io a limited, non-exclusive, royalty-free license to store, transmit, and display your content solely for the purpose of providing the Service. This license terminates when you delete the content or when it expires.

FileShot.io's Service, including its design, features, functionality, and content (excluding user-uploaded files), is owned by FileShot.io and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

13. DMCA Takedown Procedures

FileShot.io respects intellectual property rights and will respond to valid DMCA takedown notices. If you believe content on FileShot.io infringes your copyright, please send a DMCA takedown notice to dmca@fileshot.io containing:

• Your contact information (name, address, phone, email)
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material (file link/URL)
• Statement of good faith belief that use is not authorized
• Statement that information is accurate and you are authorized to act
• Your physical or electronic signature

We will process valid DMCA notices promptly and may terminate repeat infringers' accounts. Counter-notifications may be submitted if you believe content was removed in error.

14. Age Restrictions and Account Security

FileShot.io is intended for users 13 years of age and older. Users under 13 are prohibited from using the Service. Users between 13 and 18 must have parental consent to use the Service.

Account Security: You are responsible for maintaining the confidentiality of your account credentials (email and password). You agree to:

• Use a strong, unique password
• Not share your account credentials with others
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

FileShot.io is not liable for losses resulting from unauthorized account access due to your failure to maintain account security.

15. Indemnification

You agree to indemnify, defend, and hold harmless FileShot.io, its operators, affiliates, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property or privacy rights)
• Content you upload or share through the Service

16. Dispute Resolution and Arbitration

Informal Resolution: Before filing a claim, you agree to contact us at admin@fileshot.io to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

Binding Arbitration: If informal resolution fails, you and FileShot.io agree to resolve disputes through binding arbitration rather than in court, except for:

• Small claims court actions (claims under $10,000)
• Intellectual property disputes (patents, trademarks, trade secrets)
• Claims seeking injunctive relief

Arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA). The arbitration will take place in the United States. You waive your right to a jury trial and to participate in class actions.

17. Export Control and International Use

FileShot.io is subject to United States export control laws and regulations. You agree to comply with all applicable export and import laws and regulations. You may not use the Service to export, re-export, or transfer files or technology in violation of any applicable export control laws, including but not limited to the Export Administration Regulations and the International Traffic in Arms Regulations.

You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, or any country that has been designated by the U.S. Government as a "terrorist supporting" country. You also represent and warrant that you are not listed on any U.S. Government list of prohibited or restricted parties.

If you are located outside the United States, you are responsible for compliance with local laws regarding online conduct and acceptable content. FileShot.io makes no representation that the Service is appropriate or available for use in all locations.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States, without regard to conflict of law principles. For disputes not subject to arbitration, you agree to the exclusive jurisdiction of the courts located in the United States.

19. Third-Party Services and Payment Processors

FileShot.io uses third-party services to provide certain features, including payment processing through Stripe. By using these features, you agree to be bound by the terms and conditions of these third-party service providers:

• Stripe: Payment processing is handled by Stripe, Inc. Your use of paid features is subject to Stripe's Terms of Service and Privacy Policy. FileShot.io is not responsible for Stripe's services, payment processing issues, or Stripe account management.
• Cloudflare: CDN and security services are provided by Cloudflare, Inc. FileShot.io is not responsible for Cloudflare's services or any issues arising from Cloudflare's infrastructure.
• Other Services: FileShot.io may use additional third-party services for email delivery, analytics, and infrastructure. We are not liable for the actions, failures, or policies of these third-party services.

FileShot.io disclaims all liability for any issues, losses, or damages arising from third-party services. You acknowledge that your use of third-party services is at your own risk.

20. Data Breach Notification

In the event of a data breach that compromises your personal information, FileShot.io will notify affected users and relevant authorities as required by applicable law. Notification will be provided via email to the address associated with your account within a reasonable time frame after we become aware of the breach, as required by applicable data protection laws including GDPR and CCPA.

For zero-knowledge encrypted files, a breach of our servers would not compromise file contents, as the encryption keys never leave your device. However, metadata (file names, sizes, expiration dates) may be accessible in the event of a breach.

21. Force Majeure

FileShot.io shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet outages, cyberattacks, government actions, or failures of third-party service providers.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FileShot.io regarding the Service and supersede all prior agreements, understandings, or communications, whether written or oral.

24. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email to registered users or through a notice on our website. Continued use of the Service after changes constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using the Service and may cancel your account.

Report Abuse

If you believe content shared through FileShot.io violates these Terms of Service or applicable laws, please report it to abuse@fileshot.io. Include the file link, description of the violation, and any relevant details. We review all reports and take appropriate action, including removal of violating content and potential account termination.
